Our country, Pakistan, was indeed founded on the ideology of Islam, but even after seven decades, no government has sincerely made any effort to implement an Islamic system. Instead, the Islamic provisions included in the Objectives Resolution approved by the founders of Pakistan, the consensus Constitution of 1973, laws protecting the belief in the finality of Prophethood, and the constitutional clauses safeguarding the honor of the Prophet Muhammad (peace be upon him) have been a source of distress and irritation for them since day one.
The current government of the Pakistan Muslim League (N) has once again attempted to undermine the provisions related to the belief in the finality of Prophethood, secretly and cunningly, to please their internal and external masters, to gain the trust of Western powers, and to fulfill promises made to them. However, due to public pressure, they had to backtrack, and their nefarious plans failed.
In the editorial of the previous issue, it was mentioned that when the oath regarding the finality of Prophethood and other related clauses were removed, the central leader of the International Council for the Protection of Finality of Prophethood, Maulana Allah Wasiya, filed a petition in the Islamabad High Court. After the first hearing, the High Court issued a stay order. After hearing the case, the honorable judge of the High Court, Mr. Shaukat Aziz Siddiqui, has now delivered a detailed judgment. This judgment is being reproduced here for public benefit and to preserve it in history:

Shaukat Aziz Siddiqui:-
For all the reasons listed below, these constitutional petitions are approved along with the following declarations and orders:
1. Islam and the Constitution of Pakistan fully guarantee all fundamental rights of minorities (non-Muslims), including religious freedom. It is the state’s duty to protect their life, property, and honor and to safeguard their interests as citizens. According to Article 5 of the Constitution, it is the fundamental duty of every citizen to be loyal to the state and abide by the Constitution and the law. This duty also applies to those individuals who are not citizens of Pakistan but are present here.
2. Every citizen of Pakistan must register their identity accurately and correctly. A Muslim is not allowed to conceal their identity as a non-Muslim, just as a non-Muslim does not have the right to present themselves as a Muslim and hide their identity. Anyone doing so is committing fraud against the state, which falls under the category of violating the Constitution and exploiting the state.
3. The definition of Muslim and non-Muslim is explicitly stated in Article 260, Clause 3, Subclauses A and B of the Constitution of Pakistan, which is recognized as a consensus of the nation. Unfortunately, necessary legislation has not been enacted according to this clear criterion. As a result, the non-Muslim minority hides its true identity and deceives the state by presenting themselves as part of the Muslim majority, leading to not only issues but also paving the way to deviate from significant constitutional requirements. The claim from the Establishment Division that there is no identity available for any officer in the civil service regarding this matter is a tragedy that contradicts the spirit and requirements of the Constitution of Pakistan.
4: Most minorities living in Pakistan have a distinct identity concerning their names and identities, but one minority recognized by our constitution does not seem to have a different identity regarding their names and general recognition. This gives rise to a serious constitutional issue, as they can easily conceal their beliefs due to their names and integrate into the Muslim majority, accessing high and sensitive positions while benefiting from the state. It should be mandatory for teachers of Islamic studies to be Muslim.
5: Addressing this situation is necessary because the appointment or election of a non-Muslim to certain constitutional positions is against our constitution. Since there is a special quota for minorities in many departments, including parliament membership, when someone from a minority hides their true religion and beliefs to deceitfully present themselves as part of the Muslim majority, they are actually violating the letter and spirit of the Constitution of the Islamic Republic of Pakistan. The state needs to take necessary measures to prevent this violation.
6: The issue of the finality of prophethood is the foundation of our religion. There are countless historical examples of attacks on this foundation. Protecting and safeguarding this foundation is mandatory for every Muslim. As a highly respected institution and representative of the people of Pakistan, Parliament is the guardian of this foundation. In this regard, it is the right of the Muslim majority to expect Parliament to be fully aware and sensitive. Along with protecting the fundamental belief of the finality of prophethood, Parliament should also consider measures to completely thwart the conspiracies of those who seek to undermine this belief. The Prophet Muhammad (peace be upon him) is the last of the prophets, and anyone claiming prophethood after him should be regarded as a liar, traitor, and outside the fold of Islam, which should also be read as part of the constitution’s declaration. Parliament has the authority to deliberate on this matter.
7: – It is encouraging that as soon as legal shortcomings were identified and the sense of error was realized, Parliament exhibited collective wisdom and demonstrated a strong sensitivity towards the matter, aligning the mentioned law with constitutional requirements at first glance. Such matters demand the same sensitivity and unity. Senator Raja Zafar ul Haq, as a seasoned lawyer and experienced parliamentarian, led a committee that produced an extremely high-quality report, comprehensively addressing all aspects of the issue with great integrity and wisdom, dispelling negative impacts. Now it is up to Parliament to decide whether to deliberate further on this matter or to abstain.
8: – The state must consider the rights, feelings, and religious beliefs of the majority and ensure the protection of the rights of minorities in accordance with the state religion, “Islam,” as defined by the constitution. Undoubtedly, the purpose of these measures is to protect society from fragmentation and to safeguard the rights of all minorities with distinct religious identities, which they possess as citizens of Pakistan. Therefore, the court issues the following directives:
i. To obtain a national identity card, birth certificate, passport, and registration in electoral rolls, applicants must provide an affidavit based on the definition of Muslim and non-Muslim as per Article 260, Clause 3, and Parts A and B of the constitution.
ii. Employment or participation in all governmental and semi-governmental departments, including the judiciary, armed forces, and higher civil services, will also be conditional upon the aforementioned affidavit.
iii. NADRA shall establish a timeframe for any citizen to correct their registered information, particularly concerning their religion.
iv. The legislature must implement necessary legislation based on the constitutional requirements, the Supreme Court’s decision 1993 SCMR 1748, and the Lahore High Court’s decision PLD 1992 L. The law should prohibit any terms specific to Islam and Muslims from being used by individuals belonging to any minority for the purpose of hiding their identity or other motives, necessitating amendments and additions to existing laws.
v. The Government of Pakistan should ensure that accurate records exist for all citizens of the state, and it should not be possible for any citizen to hide their true identity and identification. Immediate action should be taken to investigate the significant discrepancies between the registered number of Ahmadis/Mirzais in NADRA and the figures collected through the census.
vi. The state is obligated to protect the rights, sentiments, and religious beliefs of the Muslim Ummah and ensure the protection of minority rights in light of Islamic teachings.
With the blessing of Allah Almighty, all esteemed lawyers, legal experts, and religious scholars have provided remarkable support during this case, and this court acknowledges their efforts. Similarly, the cooperation of all government officials from various departments has been commendable. Furthermore, Mr. Arshad Mahmood Kiyani, Deputy Attorney General, played an exemplary role and skillfully fulfilled the responsibilities assigned by the court through his constant diligence, helping the court reach accurate conclusions.
This order is being issued in both Urdu and English.
As readers have noted, the Supreme Court has declared that under Article 5 of the Constitution, it is a fundamental duty of every citizen to be loyal to the state and abide by the Constitution and law. It has been repeatedly proven that Ahmadis not only disclose important secrets of Pakistan abroad but also defame the country. Furthermore, they have yet to accept the unanimous decision of Parliament from September 7, 1974. So, should we call this loyalty to the state or treason? Is this adherence to the Constitution and laws, or is it a violation and rebellion against them?
The court has also clarified that whether Muslim or non-Muslim, anyone who hides their identity is committing deception against the state, which falls under the categories of violating the Constitution and exploiting the state. Now, what can be said about those Ahmadis who have been deceiving the state, violating the Constitution, and exploiting the nation by hiding their identity from the establishment of Pakistan until now? The disagreement between Muslims and Ahmadis lies precisely in the fact that they should adopt their identity, just like other minorities proudly identify as Jews, Christians, Hindus, Sikhs, Parsis, and so on. Why don’t Ahmadis do the same?
The court has also mandated that it should be a requirement for teachers to be Muslim in order to teach Islamic studies in government schools, colleges, and universities. Now it is the responsibility of the government and institutions to comply immediately with the Supreme Court’s order and to impose appropriate punishment on those Ahmadis who have taken advantage of Pakistani institutions while hiding their identity, seizing their property and depositing it into the state treasury.
Similarly, those who have infiltrated institutions while hiding their identity should be required to clarify their identity by a specified date; otherwise, they should be removed from public office and even punished for deceiving the state, violating the constitution, and exploiting the state.
It’s also worth considering that the architect of the Pakistan ideology, the respected Allama Iqbal, had stated long ago that “Ahmadis are traitors to the country and the nation.” So why hasn’t this been trusted until now? Why haven’t they been kept under close watch? And why hasn’t any action been taken to curb their secret machinations?
Despite the fact that former Prime Minister Zulfikar Ali Bhutto had once stated that Ahmadis want to attain the same position and status in Pakistan as Jews have in America. Reports from intelligence agencies attest that Ahmadis are behind every crisis in Pakistan.
Now, the honorable Justice Shaukat Aziz has made a historic decision, and prior to this, he had also taken notice of the inappropriate and vulgar actions of internet bloggers and ruled against them. Now, conspiracies against him have already begun, as reported in the Daily Jang Karachi on Tuesday, 24 Jumadi al-Thani 1439 AH, March 13, 2018.
In any case, it is the duty of all Muslims to remain vigilant and cautious of Ahmadis, their lobbies, and those who support Ahmadis, because it is in their nature to strike secretly and from behind. We must ensure that they do not succeed in scheming against the esteemed judge, leaving Muslims to rue their inaction.
The International Congress for the Protection of the Finality of Prophethood, organized by the World Assembly for the Protection of the Finality of Prophethood, was held on Saturday, March 10, 2018, at the Badshahi Mosque in Lahore. The conference consisted of three sessions. Different sessions were presided over by the central leaders of the World Assembly, including Maulana Dr. Abdul Razak Iskander, Deputy Amir Maulana Aziz Ahmed, and Maulana Pir Hafiz Nasiruddin Khakwani. The special guests included Maulana Fazlur Rehman, central Amir of Jamiat Ulema-e-Islam, and Mufti Muhammad Rafi Usmani, the Grand Mufti of Pakistan. Other notable attendees were Maulana Qari Muhammad Hanif Jalandhari, Secretary-General of the Federation of Madrassas Arabia Pakistan, Allama Professor Sajid Mir from the Central Jamiat Ahle Hadith, Maulana Shah Owais Noorani from Jamiat Ulema Pakistan, Maulana Dr. Abul Khair Muhammad Zubair, Federal Minister for Religious Affairs Sardar Muhammad Yousaf, Maulana Muhammad Amjad Khan, the central acting Secretary-General of Jamiat Ulema-e-Islam, Maulana Fazal-ur-Rehman from Jamia Ashrafia, Allama Professor Sajid Mir, Maulana Syed Zia Ullah Shah Bukhari, Maulana Zahid al-Rashidi from the Pakistan Shariah Council, Maulana Dr. Saeed Ahmad Inayatullah, a guest from Mecca, Fareed Ahmad Paracha, a central leader of Jamaat-e-Islami Pakistan, the Sajada Nasheen of Khanqah Kot Mithan Khawaja Moinuddin Koria, Raja Muhammad Sidique, a member of the Azad Kashmir Assembly, Maulana Allah Wasaya, and Maulana Mufti Shihabuddin Popalzai from the World Assembly for the Protection of the Finality of Prophethood, along with a large number of scholars and millions of people participated in the event.
The inaugural address was delivered by your son and a professor at Jamia Uloom Islamia Allama Banuri Town, Hazrat Maulana Dr. Saeed Khan, on behalf of the head of Jamia Uloom Islamia Allama Banuri Town, the Amir of the International Council for the Protection of Finality of Prophethood, and the President of Wifaq-ul-Madaris Al-Arabia Pakistan, Hazrat Maulana Dr. Abdul Razzaq Iskander. Among other points, he mentioned:
“Esteemed guests! The International Council for the Protection of Finality of Prophethood still adheres to a policy of peace and non-violence to safeguard the belief in the Finality of Prophethood. Never forget that all our successes, from the pulpit to the National Assembly and from local courts to the Supreme Court, have come through peaceful efforts. As long as our struggle remains non-violent, success will greet you. The day we allow the enemy’s tactics to lead us down a violent path and abandon the methods of our respected predecessors, that will be a regrettable time for the movement for the Finality of Prophethood. Carry the message from this gathering that anyone who embraces violence in the name of protecting the belief in the Finality of Prophethood is either unaware of the spirit of this movement or has fallen victim to the enemy’s tactics. If you continue to hold the Qadianis accountable within the framework of the law using peaceful means, you will witness the idol of Qadianism fall so dramatically that once the dust settles, not a trace of Qadianism will remain. God willing! And then God willing! That time is near, and this gathering, by the grace and mercy of Allah, will lay the foundation for a new struggle. And that is not difficult for Allah!”
Ladies and gentlemen! Qadianism is just another name for rebellion against Islam. Qadianism is a cursed group of rebels against the Prophet Muhammad (peace be upon him), whose very existence is based on the disrespect of the Messenger of Allah (peace be upon him). It is our duty to protect every individual of the Ummah from them. To this end, I would like to draw your attention to a few measures through this gathering:
1: Every religious scholar should dedicate one Friday a month to discussing the belief in the Finality of Prophethood. For example, in a city, let there be a discussion against Qadianism in a hundred mosques on that Friday. If we assume there are a thousand people in each mosque, we could reach up to a hundred thousand people in just one city. Thus, if a nationwide plan takes off where there are discussions on the Finality of Prophethood every month on Fridays, you’ll be conveying the message of the Finality of Prophethood to millions across the country every month. With just a little attention from the scholars, the entire country can become a platform for the message of the Finality of Prophethood. I hope you will not only pay attention to this but also spread the word to those who are not present, and encourage them to join in as well.
2: You all should avoid Qadianism through peaceful struggle and positive effort. Educate people. I do not shake hands with a cursed person, an enemy of the Messenger of Allah (peace be upon him), nor do I buy anything from his shop. What law in the world forces me to do otherwise? It is my right to self-determination that if I do not associate with my parents’ enemies, then I should not associate with the enemies of the Messenger (peace be upon him) either. The Qadianis call themselves Muslims while declaring Muslims, the followers of the Messenger (peace be upon him), and the entire Muslim Ummah as infidels. They regard Mirza Qadiani as a prophet and those who follow him as companions; they call Mirza Qadiani’s wife Ummul-Mu’mineen and his family Ahlul Bayt. They have created a facade of Bhesht-e-Maqbara compared to Jannat-ul-Baqi. They are disguising their infidelity with Islamic terminology. They are ruining our identity. The Constitution of Pakistan states that Qadianis are infidels. By calling themselves Muslims, they are openly rebelling against the Constitution of Pakistan. By branding Muslims as infidels, they are bent on annihilating the very existence of the Muslim Ummah. Avoiding them and saving all Muslims is a duty for us. If we do not work to protect the honor and dignity of the Messenger of the Worlds (peace be upon him) and do not fulfill our responsibilities, we should fear that our hearts may have become rusted. Are we not complicit with these accursed Qadianis in enmity against the Messenger (peace be upon him) by maintaining relations with them?
3: Due to the initiative of the International Council for the Protection of the Finality of Prophethood, more than fifty important cities now have centers named “Khatm-e-Nubuwwat Chowk,” and naming these centers is a form of continuous outreach. At this election stage, candidates should be asked to establish Khatm-e-Nubuwwat Chowks in important cities within their constituencies. This is an opportunity to be fully utilized.
4: There will be an annual Khatm-e-Nubuwwat course in Chenab Nagar from the 4th to the 25th of Sha’ban, and everyone should participate enthusiastically.
Dear brothers! Prayer, fasting, pilgrimage, almsgiving, preaching, and jihad are all duties related to the actions of the Prophet Muhammad (peace be upon him). The finality of Prophethood is connected to his personality. Protecting and honoring the dignity of the Prophet (peace be upon him) is among the greatest duties. While we may fulfill other obligations, if we do not care for the dignity and honor of the Prophet (peace be upon him), we risk not only invalidating our good deeds but also missing out on his intercession on the Day of Judgment. How beautifully it is said:
Prayer is good, fasting is good, pilgrimage is good, almsgiving is good,
But even with all that, I cannot truly be a Muslim
Unless I sacrifice myself for the respect of the Lord of Bitha.
God is my witness; my faith cannot be complete.
You should become a living example in protecting the honor and dignity of the Messenger of Allah (peace be upon him), and at the very least, you should avoid the Qadianis. If you can’t even do that, then reflect on whether we even have faith. Use the strategy of avoiding this rebellious Qadiani group to bring them back to the right path, so they realize that by following the cursed Mirza Qadiani, they cannot be considered part of the Muslim Ummah. Once they develop this realization, they will be compelled to remove the yoke of Mirza Qadiani’s servitude from their necks. I hope this peaceful struggle will be a great success.
While addressing the conference, the leader of the Jamiat, Maulana Fazl-ur-Rehman, said: When the belief in the Finality of Prophethood was attacked and scholars from all sects in India confronted all conspiracies through a comprehensive strategy, all tyrannical forces were behind it. However, the unity displayed by the Pakistani nation resulted in their victory while the global powers were defeated. Your unity preserved the dignity of your sacrifices. During the 1953 movement for the Finality of Prophethood, the streets of Lahore were colored with the bodies of ten thousand advocates of the Finality of Prophethood. Through this gathering, we want to send a message to the colonial powers that you can never eradicate the non-Muslim status of the Qadianis from the land of Pakistan. The Finality of Prophethood is our shared belief. We have always lamented that the rulers are not implementing Islam, the parliament is not legislating according to Islamic law, the Islamic provisions have been altered, the constitution has been suspended, and the law regarding the Finality of Prophethood has been put on hold. The rulers and members of parliament are responsible for this, and we have never played a role in bringing the defenders of the belief in the Finality of Prophethood into the assembly. As a small number, we are strategically playing our part in this house to protect the belief in the Finality of Prophethood and the dignity of the Messenger. He further stated: Pakistan’s constitution states that Islam will be the state religion of Pakistan and legislation will be according to the Quran and Sunnah, with no law conflicting with them. Legislation is the job of the parliament, and you have sent individuals to that parliament who do not even know Surah Ikhlas. You expect them to legislate according to the Quran and Sunnah? Today, regular lobbies and NGOs have infiltrated institutions like termites, secretly working to change the laws regarding the Finality of Prophethood.
Maulana Mufti Muhammad Rafi Usmani stated: Those Qadianis who pretended to be Muslims to secure jobs and then converted back to Qadianism after retiring should be subjected to the punishment for apostasy according to Shariah. Therefore, the current government should impose this punishment on them.
The Secretary-General of the Federation of Madaris-e-Arabia Pakistan, Maulana Qari Muhammad Hanif Jalandhari, stated that after the report of the committee formed under Raja Zafar-ul-Haq is made public, those identified as criminals should be punished. The names of innocent scholars should be removed from the Fourth Schedule. The crackdown on religious schools should be stopped, and the topic of the finality of Prophethood should be included in the curriculum in detail.
The head of the Central Jamiat Ahl-e-Hadith, Allama Sajid Mir, and Maulana Syed Ziaullah Shah Bukhari said that the finality of Prophethood is a fundamental belief of Islam. The entire structure of Islam is built upon the belief in the finality of Prophethood. Siddiq Akbar (RA) laid the foundation of the finality of Prophethood movement, sacrificing twelve hundred Companions (RA) and Tabi‘in (successors) for its protection. Adhering to the Sunnah of Siddiq, they will not shy away from any sacrifice for the protection of the belief in the finality of Prophethood.
Maulana Shah Owais Noorani of Jamiat Ulema Pakistan mentioned that the sons of Maulana Shah Ahmad Noorani and Maulana Mufti Mahmood have neither betrayed the great mission of the finality of Prophethood nor struck any deals. In the 2018 elections, those who mocked Islam and Islamic symbols and betrayed the laws safeguarding the honor of the Prophet and the finality of Prophethood will find no refuge.
Maulana Dr. Abu al-Khair Muhammad Zubair from JUP said that the rulers are devising new tricks and excuses to undermine the laws protecting the honor of the Prophet and the finality of Prophethood. Attempts are being made to make arbitrary amendments to the law of finality of Prophethood, and it’s also being suggested that anyone filing false charges of blasphemy should be punished for blasphemy as well. He questioned whether the same law applies in other cases, asking if someone files a false murder case, should they also be punished for murder, or if someone files a false treason case, should they also be punished for treason? If not, then why is this being done with the laws of finality of Prophethood and protection of the Prophet’s honor? Such legislations are schemes to make these laws ineffective.
Speaking at the event, Maulana Dr. Mian Muhammad Ajmal Qadri, head of the Anjuman Khuddam-ul-Din, stated that the creator of Pakistan, Allama Iqbal (RA), once said, “Qadiyanis are traitors to the nation and the community.” Pursuing the traitors of the community will bring solace to the soul of Allama Iqbal (RA).
The central leader of Jamaat-e-Islami, Fareed Ahmad Paracha, stated that the protection of the belief in the finality of prophethood is a hallmark of the Global Council for the Protection of Finality of Prophethood. The movements for the finality of prophethood in 1953, 1974, and 1984 were hosted by the council and achieved success.
Shaheen-e-Khatm-e-Nabuwat, Maulana Allah Wasaya, remarked that the belief in the finality of prophethood is a cherished possession of all Muslims, and it will not be sacrificed on the altar of politics. He emphasized that our elders kept it safe from politics and sectarianism so that all sects and political parties could unite on this platform to protect the finality of prophethood of the beloved Prophet Muhammad (peace be upon him).
At this conference on the finality of prophethood, the following resolutions were also passed:
“1. The conference demands that the government enforce the Shari’ah punishment for apostasy in accordance with the recommendations approved by the Islamic Ideological Council.
2. Ensure the implementation of the Qadiani Prohibition Law and the Law for the Protection of the Messenger’s Honor.
3. This assembly expresses concern over the rising trend of blasphemy in the country, deeming it akin to inviting divine punishment, and demands that the government of Pakistan enforce the blasphemy law strictly in its true spirit so that no miscreant dares to commit blasphemy.
4. The assembly appeals to the speakers across the country to dedicate one Friday each month to discuss the belief in the finality of prophethood, so that the younger generation understands the seriousness of Qadiani beliefs.
5. The assembly congratulates the joint meeting of the Azad Kashmir Assembly and Council on February 6, 2018, for including all laws related to the finality of prophethood passed by Pakistan as part of Azad Kashmir law.
6. The assembly expresses gratitude to the scholars of religious schools in Lahore and surrounding areas, the Coordination Committee of the Khatm-e-Nabuwat Conference, as well as the hundreds of young individuals fulfilling security duties, and the institutions, especially the Punjab government and the Auqaf Department, that worked for the success of the conference, praying that Allah grants them a fitting reward.
7. The assembly strongly condemns the horrific massacre occurring in Syria and calls on the leaders of the Islamic world to fulfill their responsibilities for rectification.
8. Through this meeting, the people of the homeland are urged to completely boycott Qadiani products and their institutions, especially all products from Shezan Company. May Allah be our supporter and helper, Ameen.”
May Allah Almighty accept all our efforts and endeavors for the protection of the honor and dignity of the Prophet Muhammad (peace be upon him). May He grant the Qadianis the ability to break away from the false prophet Mirza Ghulam Ahmad Qadiani and connect to the legacy of the Prophet Muhammad (peace be upon him). May He protect Pakistan and all its institutions from conspiracies and bless the Pakistani people with safety, peace, and prosperity. Ameen.
