The question of whether the Qadiani can perform the sacrifice or not has been gaining importance for some time. The law of Pakistan though is very clear in this matter as under Section 298-C of Pakistan Penal Code it is clear that Qadianis cannot pretend to be Muslims and they cannot practice Islamic rites i.e. specific acts and symbols of Islam. Since sacrifice is also one of the Islamic rites, Qadianis do not allow it.
But for the last one or two years, some people have been unsuccessfully trying to prove this illegal act of the Qadianis as constitutional and legal. Their position and reasoning is that the constitution and religion of Pakistan do not prohibit the Qadianis from performing sacrifices within their house of worship and within the four walls, and to prevent them from doing so is a violation of their [fundamental rights]. To what extent this reasoning is correct, let us try to evaluate it.
First of all, it should be understood that the crime is a crime whether inside or outside the four walls. Just like selling hashish and heroin is a crime outside the four walls, it is also a crime inside the four walls and the punishment is the same and equal in both cases.
Secondly, sacrifice is an Islamic slogan that cannot be limited to a place of worship or four walls. Rather, it has different stages which are also related to public places, such as going to the cattle market to buy a sacrificial animal, tying the sacrificial animal in the street, buying fodder for the animal, and arranging for a butcher to slaughter it. , throwing out its blood and ashes, distributing the sacrificial meat, etc. All these matters are such that when the Qadiani perform the act of sacrifice, they will inevitably perform them. This basically gives them three benefits.
Number one is to create suspicion among ordinary Muslims that they are also Muslims because during the three days of Eid-ul-Adha, Christians, Hindus or Sikhs do not offer sacrifices.
Number two is to create a soft corner in the hearts of Muslims regarding Qadiyanism through this process.
Number three is to pave the way for the propagation of your religion among simple Muslims so that when they take meat from them and eat it, they are forced to listen to them and in practice this is also happening. It seems that sacrifice is a kind of preaching process which starts with sacrifice but it ends with the preaching of Mirzai religion.
Before understanding the third important thing, we have to understand the word slogan. Slogan refer to something that becomes the distinctive identity of a religion. Its plural is Slogans, as Pakistan’s renowned religious scholar Mufti Muhammad Shafi Sahib writes in his famous Tafsir Marif al-Qur’an that Slogans are said to be specific things that symbolize something. The rituals of Islam will be said to be those actions which are considered to be a sign of being a Muslim.
From this description, we have come to know that the rites of Islam refer to those specific actions and signs of Islam by which the Islam of a person or group will be known and whoever expresses these signs will be considered a Muslim. Qadianis try to identify themselves as Muslims through the act of sacrifice, while Muslims demand that this act of Qadianis affects their identity. So their identity should not be allowed to be misused inside or outside the four walls.
This is a legitimate demand of the Muslims and the question arises as to how it affects the rights of the Qadianis? And if this demand presents any problem to the Qadianis, then the Muslims are not responsible for it, but they are themselves, and it is their responsibility to find a solution for it. What kind of justice is it that if a group fraudulently ascribes the registered rights and inheritance of someone to themselves and that person raises his voice against this group, then on the contrary, he should be made to stand in the dock and be told that you have your rights. Refrain from claiming that it is affecting the other party.
By allowing the Qadianis to sacrifice, the rights of the Muslims are being affected, not the Qadianis, and the identity of the Muslims is being taken away, not the Qadianis. And the strange thing is that instead of explaining the Qadianis, Muslims are being blamed and propaganda is being done against them.
At the end of this, we demand from the Qadianis that first of all they recognize their position given in the constitution of Pakistan and fully abide by the constitution and law and secondly, as they did after the Holy Prophet (PBUH) as Mirza. By recognizing Ghulam Qadiani as a prophet, they have laid the foundation of a separate religion and a separate Ummah. In the same way, they should devise new terms for their religious worship and rituals instead of cheating by using Islamic rituals. And the interesting thing is that the highest court of Pakistan i.e. the Supreme Court has given this advice to the Qadiani Jamaat in its 1993 decision.
