Despite the constitutional declaration of the Mirzais as non-Muslims in 1974, the practice of pretending to be Muslims and deceiving Muslims continued, resulting in two important decisions by the Shariat Court in 1985 and the Supreme Court in 1993. released The summary of the decision of the Shariat Court was that Mirzais prove themselves to be Muslims by adopting Islamic rituals and deceive the simple Muslims, therefore they cannot openly adopt the religious rituals of Muslims and do not allow any religious group to follow the specific rituals of Muslims. Withholding does not contradict Islamic injunctions. The gist of the Supreme Court’s decision was that in view of the deceitful behavior of the Mirzais, preventing them from openly adopting Islamic rituals is not against basic human rights even according to the Pakistani constitution. It seems that both the Supreme Court and the Sharia Court have confirmed in their decisions that preventing the Mirzais from practicing Islamic rituals is correct according to the Islamic and Pakistani constitution. The issues that were justified in both the decisions were that Mirzai does not refrain from cheating by proving himself to be a Muslim, and secondly, that when there is a danger of disturbance of peace due to the actions of a religious group, its Rights
can be limited by restrictions. In 2022, a case was filed in the Supreme Court asking the Mirzais to adopt Islamic rituals (such as the presence of the Qur’an in the mosque and the writing of the Kalima Tayyaba) and to include the blasphemy and blasphemy provisions on them. . Justice Mansoor Ali Shah and Justice Aminuddin Khan heard it, the court remarked that the decision of the Sharia Court and the Supreme Court, prohibiting the Mirzais from adopting Islamic rituals, did not affect their fundamental rights. According to the Pakistani constitution, it only deals with the practice of Islamic rituals in public and open places. If a Mirzai practices Islamic rites inside his place of worship, stopping him from doing so would be a violation of his fundamental rights and is against the Islamic laws and constitution of Pakistan. Because Islamic injunctions and the constitution of Pakistan allow every citizen to practice his religion within his place of worship.
There is a common contradiction in the decisions of Sharia Court 1985, Supreme Court 1993 and Supreme Court 2022 and that is that Mirzais cannot practice Islamic rituals in public but they can practice Islamic rituals inside their place of worship. In other words, in all the three decisions, the basic principle was accepted that the Mirzais do not refrain from cheating and try to defraud the simple Muslims, but the order deviating from this principle was restricted, that cheating in public is prohibited. No Yes Cheating is allowed inside the synagogue. In principle, this contradiction should have ended and the Mirzais should not have been allowed to adopt Islamic rituals even inside the place of worship, but in practice this could not happen and these flawed and incomplete decisions were accepted as temporary and traditional expedients. went For example, it has been temporarily and traditionally accepted that the Mirzai should continue to perform those prayers or Islamic rituals that take place inside the place of worship, but they are not allowed to perform such prayers or Islamic rituals that are related to public places instead of the place of worship. was According to this legal interpretation, the Mirzais were not allowed to sacrifice because the sacrifice was a ritual that belonged to public places rather than places of worship. For example, going to the cattle markets to buy a sacrificial animal, tying the sacrificial animal in the street and making the local people believe that they are Muslims, deceiving the Muslims that they are Muslims by performing a sacrifice in a big mansion or an open house. And after the sacrifice, by distributing the meat of the sacrifice in the Muslim settlements, to create a soft corner in their hearts and invite them to come to their places of worship. Based on all these actions, the legal interpretation and tradition was that the Mirzais were not allowed to worship like Qurbani or adopt slogans, and the Mirzais themselves continued to accept this legal interpretation and tradition.
After the Supreme Court’s decision in 2022, the Mirzais started propagating that according to Justice Mansoor Ali Shah’s decision, they were also allowed to perform sacrifice, although there was no mention of sacrifice in Justice Mansoor Ali Shah’s decision. This judgment was mainly regarding the presence of Quran and Kalma inside the Mirzais’ place of worship and only in this regard, Justice Mansoor Ali Shah, referring to previous cases, ruled that the Mirzais were allowed to use their own methods inside their place of worship. It is allowed to worship or adopt Islamic rituals. In this whole case, there was no mention of sacrifice, so the legal interpretation and tradition regarding sacrifice was the same as it had been going on before. It was understandable for the Mirzais to propagate the new legal interpretation and justification of sacrifice based on the decision of Justice Mansoor Ali Shah, but the Muslim scholars and intellectuals rejected the previous legal interpretation and tradition regarding sacrifice and new legal interpretation. It was beyond understanding why they came to the field. In order to reject the earlier legal interpretation of sacrifice, the narrative was concocted, creating confusion, that it is worship organized within four walls. As if until now the Mirzais and Muslims themselves did not know that this worship is done within four walls and now after the decision of 2022, this fact has been revealed to the Mirzais and some of their supporters. It is clear that sacrifice cannot be declared as an act done within four walls, nor can it be presumed on prayer, recitation and speech, because prayer, recitation and speech are obligatory acts which are limited only to the perpetrator, but Sacrifice is a contagious act that transcends others, leaves an impact and creates consequences. The principle thing is that all the actions and actions of the Mirzais regarding the adoption of Islamic rites, in which there is an element of betrayal and fraud, the Muslim community will have to raise their voice against it and the Mirzais will have to be held legally accountable.
